MTN's problems deepens as Etisalat Nigeria files in a court action preventing them from using the 800MHz spectrum. MTN explains that its acquisition of Visafone gave them free hands to utilize this spectrum. Etisalat Nigeria argues that the continual usage of this spectrum by MTN would further strengthens MTN dominance of the telecommunication market in Nigeria overthrowing other competitors currently using this broadband spectrum..
It would be recalled that MTN's 3.9billion USD fine by the Nigeria Communications commission for failing to deactivate all unregistered SIM cards is still pending in court and no logical conclusion has been reached yet. Though MTN says this is not the first time Etisalat Nigeria is serving them a court summon over a bussiness issue and theey are ready to file in an objection suit.
